Abstract

The proliferation of the instrumentalization of immigration in several areas along the European Union's external borders has contributed to a crisified perception of human mobility. This study aims to determine how the Union has definitively succumbed to the securitizing discourse in the field of migration and how this has been reflected in European legislation. By examining cases where migration is clearly instrumentalized, such as Turkey, Morocco, and Belarus, the practices of Member States and the reaction of European institutions to this instrumentalization will be revealed. A review of various EU legal mechanisms, particularly the Crisis and Force Majeure Regulation, will help to determine the EU's level of commitment to its values, specially, to fundamental rights.
