The Law 54/2007 of 28 December, on International Adoption, which entered in force on 30th December 2007, has amended the rules of procedure relating to international adoption. The objective of this law is to provide the necessary legal instruments so that the adoptive process takes place with maximum guarantees and the respect for the interests of the children to be adopted. The new Act wants to cover all the involved issues of Private International Law: applicable law, jurisdiction, recognition and enforcement of foreign decisions in matters of adoption. The Spanish legislator has intended to eliminate - although sometimes fails - the legal deficiencies which have motivated in the past unfortunate judicial judgments. The interest of this new Act is evident for many reasons and not all of a legal character.
