One of the key objetives in the review process of Regulation 44/2001 was to improve its operation at international level, with the application of the rules on international jurisdiction to defendants domiciled in third countries. The objective was to eliminate the subsidiary role of national rules. However, Regulation 1215/2012 has finally extended the scope of application of just a limited number of rules. This article analyses the interpretative problems which may cause this solution as well as its impact on our national system of international jurisdiction.
