The imperative nature of the new package travel and linked travel arrangements rules

Abstract

Pending its final validation as a Proyecto de Ley, the new Libro Cuarto del Texto Refundido de la Ley General para la Defensa de los consumidores y usuarios y otras leyes complementarias must reflect the innovations introduced by Directive (EU) 2015/2302 on Package travel and linked travel arrangements, among them should reflect the imperative nature of its provisions in accordance with Article 23 of Directive (EU) 2015/2302. The aim of this paper is to analyze the repercussions of the imperative nature of the provisions on Package travel and linked travel arrangements, especially in the field of conflicts laws, which reinforces the substantive regulation of this contracts.
