Challenges and dilemmas of a treaty on the prevention and punishment of crimes against humanity in the 21st century

The object of this Study is the definition of crimes against humanity in the Draft articles on the prevention and punishment of crimes against humanity of the International Law Commission. I explain why and for what purpose a treaty is proposed on this matter, how this notion has been approached and what dilemmas these crimes still present in the current stage of international criminal law, especially in relation to customary international law that characterizes the process of prohibition and criminalisation and, likewise, the nature of these crimes.
