Abstract

This paper analyzes the new cases of acquisition of Spanish nationality by option provided for in the Law 20/2022 of Democratic Memory, as well as the impact that this regulation may have on the free movement of persons. In a short period of time, a large number of people will acquire Spanish nationality and, therefore, EU citizenship. A series of issues inevitably arise that will be addressed in this paper as: a) if the Spanish State can freely legislate in matters of nationality or if the EU has any competence in this regard; b) what consequences will the plurinationality recognized unilaterally by Spain have for the application of EU standards and, finally, c) the rights of free movement of relatives from third States of Spaniards who have acquired nationality through Law 20/2022.
